Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the VibeChecker mobile application (“the App”) operated by FFWD Florian Werner Digital Ventures (“us,” “we,” or “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to any part of the Terms, then you may not access the App.

1. Eligibility

The App is intended for users of all ages, following the App Store Connect guideline of 4+. However, if you are under the age of 14, you must obtain permission from a parent or legal guardian before using the App.

2. One-Time Use Policy

  • Single-Use Limitation: The App can only be used once to generate a Vibe Check.
  • Viewing and Sharing: After generating your Vibe Check, you can continue to view and share it as often as you like.
  • No Second Attempt: If you delete and reinstall the App, you will not be able to generate another Vibe Check.
  • Intentional Design: This limitation is part of the app’s unique concept, ensuring every Vibe Check remains a one-time, special experience.

3. Purchase and Refund Policy

  • One-Time Purchase: The App requires a single, upfront purchase to generate a Vibe Check.
  • Payment Processing: Payment is processed through your Apple ID at the time of purchase.
  • No Refunds: We do not offer refunds once the purchase has been made, except as required by Apple’s refund policy.
  • Managing Your Purchase: You can view your purchase history in your Apple ID settings.

4. Use of the App

4.1. Personal Use

  • The App is intended for personal, non-commercial use only.
  • You agree not to misuse the App or attempt to bypass its one-time use limitation.

4.2. AI Processing and Data Handling

  • Image Processing: Your selected image is sent to the OpenAI API for analysis.
  • No Image Storage: We do not store or retain any images after processing.
  • Generated Content: The AI-generated vibe descriptions are stored locally on your device.

5. Intellectual Property Rights

  • Ownership: All content, features, and functionality of the App are owned by us and protected by international copyright, trademark, and other intellectual property laws.
  • License: You are granted a limited, non-exclusive, non-transferable license to use the App for personal use.

6. Third-Party Services

6.1. OpenAI API

  • VibeChecker uses the OpenAI API to generate Vibe Checks.
  • No Permanent Storage: Your image is processed and immediately discarded after generating results.
  • Third-Party Policies: OpenAI’s processing of data is subject to their own Privacy Policy.

6.2. Superwall

  • Subscription Management: Superwall is used to handle the in-app purchase process.
  • Third-Party Terms: By making a purchase, you agree to Superwall’s Privacy Policy.

7. Disclaimers and Limitation of Liability

7.1. Disclaimers

  • AS IS Basis: The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
  • No Guarantees: We do not guarantee that the AI-generated Vibe Check will be accurate, meaningful, or personalized to your expectations.

7.2. Limitation of Liability

  • No Indirect Liability: To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages resulting from the use of the App.
  • Liability Cap: Our total liability shall not exceed the purchase price you paid for the App.

8. Governing Law and Jurisdiction

  • Applicable Law: These Terms are governed by the laws of Germany, without regard to its conflict of law provisions.
  • Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of the courts located in Erlangen, Germany.

9. Changes to Terms

  • Right to Modify: We reserve the right to modify or replace these Terms at any time.
  • Notice of Changes: If a revision is material, we will notify users at least 30 days in advance.
  • Acceptance of Changes: By continuing to use the App after changes take effect, you agree to the updated Terms.
